These Terms & Conditions govern your use of the Stored Moments website and the purchase and use of our products and services. By placing an order with Stored Moments, creating an account, uploading content, or using our services, you agree to these Terms & Conditions.
Custom & Personalized Products
Stored Moments shadowboxes are individually handcrafted and personalized using the names, wording, engraving, dates, messages, and other information you provide. Because each product is custom-made, customers are responsible for reviewing all personalization information carefully before submitting an order.
Once production has begun, changes may not be possible. Personalized products are subject to our Returns & Cancellations Policy.
Orders & Payment
All orders must be paid in full at the time of purchase unless otherwise stated. Prices displayed on the Stored Moments website are in U.S. dollars and may be changed at any time without notice.
An order is considered accepted once payment has been successfully processed and an order confirmation has been issued. Stored Moments reserves the right to cancel or refuse an order if there is a pricing error, payment issue, suspected fraud, or other circumstance that prevents us from fulfilling the order.
Production & Shipping
Because Stored Moments products are handcrafted and personalized, production times may vary. Any production or delivery estimates provided are estimates and are not guaranteed delivery dates.
Customers are responsible for providing an accurate shipping address. Once an order has shipped, delivery is subject to the carrier’s schedules and conditions. Additional information regarding shipping is available in our Shipping Policy.
Customer-Provided Content
Customers may provide photographs, video clips, stories, names, messages, and other content for use in creating their Stored Moments shadowbox and personalized Video Slideshow.
By providing this content, you confirm that you have the right or permission to provide and use it for these purposes. You retain ownership of your content and grant Stored Moments permission to use, reproduce, resize, edit, format, combine, and display the content as reasonably necessary to create, fulfill, maintain, host, and provide the products and services you requested.
Customer Content & Prohibited Material
Customers are responsible for the content they submit to Stored Moments. You may not submit content that is unlawful, threatening, abusive, defamatory, obscene, infringes the intellectual property or privacy rights of another person, or that you do not have permission to use.
Stored Moments reserves the right to decline, remove, or refuse to use submitted content that we reasonably believe violates these Terms, applicable law, or the rights of another person.
Video Slideshows & Digital Access
Certain Stored Moments products may include a personalized Video Slideshow created using customer-provided photographs, video clips, stories, messages, and other content.
Video Slideshows may be hosted using third-party video or hosting services and made accessible through a Stored Moments Watch Page. When included with a shadowbox, the Watch Page may be accessed through the NFC feature or QR code incorporated into the physical product, as well as through other links provided by Stored Moments.
Video Slideshow and Watch Page availability may depend on internet access, compatible devices, browsers, third-party hosting services, and other technologies outside the direct control of Stored Moments. Stored Moments may reasonably change the technology, hosting provider, delivery method, or service used to provide digital content while maintaining the intended functionality of the service.
Unless expressly stated otherwise, a Watch Page should not be considered a private or password-protected storage service. Customers are responsible for deciding what photographs, videos, messages, and other personal content they choose to submit for inclusion in their Video Slideshow.
Intellectual Property
The Stored Moments name, logo, website design, product designs, graphics, text, and other business materials created by Stored Moments are owned by or licensed to Stored Moments and may not be copied, reproduced, distributed, or used for commercial purposes without permission.
Customer-provided photographs, videos, stories, messages, and other original customer content remain the property of their respective owners, subject to the permissions granted to Stored Moments under these Terms for providing the requested products and services.
Service Availability
Stored Moments works to keep its website, customer accounts, Watch Pages, Video Slideshows, and related services available and functioning properly. However, uninterrupted or error-free access cannot be guaranteed.
Services may occasionally be unavailable due to maintenance, technical issues, internet or hosting disruptions, third-party service interruptions, security concerns, or circumstances beyond our reasonable control. Stored Moments may modify, update, replace, or discontinue features when reasonably necessary to operate, maintain, secure, or improve our services.
Limitation of Liability
To the fullest extent permitted by applicable law, Stored Moments will not be liable for indirect, incidental, special, or consequential damages resulting from the use of, or inability to use, our website, digital services, or products.
Nothing in these Terms is intended to exclude or limit any rights or remedies that cannot legally be excluded or limited under applicable law.
Changes to These Terms
Stored Moments may update these Terms & Conditions from time to time to reflect changes to our products, services, website, business practices, or legal requirements.
Updated Terms will be posted on this website and will become effective when posted unless otherwise stated. Your continued use of our website or services after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Governing Law
These Terms & Conditions and any dispute arising from the use of the Stored Moments website, products, or services will be governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles, except where otherwise required by applicable law.
